Remember the Phrase Use of Web Site Constitutes eBay Acceptance? One thing that you need to know when using online auctions such as eBay is that use of the web site constitutes eBay acceptance. When you place a bid, it is a contract. It may be in a digital form but it is the same as a legal contract you would sign in person. You are obligated by this contract. To learn more about it, you should fully read the User Agreements and Privacy Policy on eBay .com and Half.com. A Bid on an Auction is a Legally Binding ContractIf you use the on line auction in any way, you are legally obligated to stand by your claims. If you post an auction, you are obligated to deliver that item. eBay prohibits “gag” or joke auctions. You must be selling an actual item and that item must be yours to sell. Of course, it is illegal to take people’s money and not deliver the item. On the same note, you can not bid on an item and then back out. Your bid is an agreement. It is as good as a signature and constitutes your willingness to pay for the item. You should never bid if you are not willing to pay. If you are dealing with either a buyer or a seller who is not living up to their end of the agreement in some way, or think you might be on the receiving end of one of the eBay scams, eBay has procedures in place for dealing with the problem. If you go the Help section, there is a category for Transaction Problems that explains how eBay handles various issues. This is always the best place to start if you’re having problems with an online auction. Related Articles
